工龄与这些待遇息息相关

连续工龄决定医疗期病假工资

工龄还跟病假工资待遇有关。职工患病或非因工负伤治疗期间,在规定的医疗期间内由企业按有关规定支付其病假工资或疾病救济费,病假工资或疾病救济费可以低于当地最低工资标准但不能低于最低工资标准的80%。

职工疾病或非因工负伤连续休假在6个月以内的企业应按下列标准支付疾病休假工资:

①连续工龄不满2年的,按本人工资的60%计发;

②连续工龄满2年不满4年的,按本人工资70%计发;

③连续工龄满4年不满6年的,按本人工资的80%计发;

④连续工龄满6年不满8年的,按本人工资的90%计发;

⑤连续工龄满8年及以上的,按本人工资的100%计发。

可见,病假待遇的高低,是与你的连续工龄息息相关的。

医疗期的计算也是依据工龄来的。企业职工因患病或非因工负伤,需要停止工作医疗时,根据本人实际参加工作年限和在本单位工作年限,给予3个月到24个月的医疗期:

实际工作年限10年以下的,在本单位工作年限5年以下的为3个月;5年以上的为6个月。

实际工作年限10年以上的,在本单位工作年限5年以下的为6个月;5年以上10年以下的9个月。

10年以上15年以下的为12个月;15年以上20年以下的为18个月;20年以上的为24个月。

经济补偿金按工龄长短算

如果员工跟单位“闹掰”了,要被终止合同,工龄的长短直接决定着员工可以从单位这里领到多少钱的经济补偿金。经济补偿按劳动者在本单位工作的年限,每满1年支付1个月工资的标准。6个月以上不满1年的,按1年计算;不满6个月的,向劳动者支付半个月工资的经济补偿。

不过,也不是所有的员工都可以被终止合同。《劳动合同法》规定,对在本单位连续工作满15年,且距法定退休年龄不足5年的劳动者,用人单位不能依据《劳动合同法》第四十条、第四十一条规定的原因与劳动者解除劳动合同。

存好工龄记录待遇莫受损

太多的待遇与工龄息息相关,因此,员工就要充分重视自己的工龄问题,千万不要让工龄受到损失。需要做的就是:

首先,要保存好有关工作经历的记录。劳动合同是工作经历最直接最有力的证明,千万要保存好。

第二,就是上面说过的人事档案。这个档案一般都是由工作单位或者人才、职介等部门保存,员工个人是不能自持档案的。虽然档案不在自己手里,但在工作有变动的时候,员工也要注意这个问题,有必要时可以跟单位的人事专员确认一下,以免将来遇到麻烦。

很多员工在工作变动时会出现一段时间的断档期,上家和下家之间没有做到“无缝衔接”,还有人因为个人灵活就业等问题,都会出现很长时间没有工作的情况。在这种情况下,这段时间就没有“工龄”了。如果不想影响到社保缴费年限的计算,可以将档案存到人才或职介机构,以灵活就业人员的身份通过这些机构继续参加职工社保。等找到新工作时,再将社保关系转移过去。这样,社保就不会中断了。
