“山东临沂女孩徐玉玉遭电话诈骗后离世”一事持续发酵。
根据公开报道，作案者几乎是“精准诈骗”，不仅知道徐玉玉母亲的电话，还知道刚刚考上大学的徐玉玉在申请助学金，最终以助学金为由，一步步诱导徐将9900元学费转到了指定账户里。
谁在泄露个人信息？是通过什么渠道和手段获取的？不法分子将会受到什么样的惩处？目前警方正在调查。
澎湃新闻从中国裁判文书网检索到10起涉及非法获取个人信息罪（或侵犯公民个人信息罪）的案例，其中5例，泄露信息者分别是学校、银行、电信企业、教育培训机构，甚至是公安机关的工作人员；另外3起案例的作案者通过技术手段入侵网络信息平台窃取个人信息；还有两起案例，涉案人员从互联网购买到公民个人信息，并向他人非法出售从中牟利。
刑法修正案（九）出台之后，非法获取公民信息罪改为侵犯公民个人信息罪，即违反国家有关规定，向他人出售或者提供公民个人信息。情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金；情节特别严重的，处三年以上七年以下有期徒刑，并处罚金。
律师梁宏刚表示，修改后的罪名扩大了适用犯罪主体的范围，但侵犯公民个人信息罪在实际中的判例并不多。一般的盗取信息、侵犯隐私行为——比如被作为商业信息、当做客户联络等，都只会按照民事案件处理。且目前可查询到的该罪案例，刑罚基本在3年以下。“此次山东临沂事件最终造成受害人死亡，如果定罪，或应该按照情节特别严重予以量刑处罚。”
5份判例中泄露者均为内鬼
判例显示，学校、银行、电信企业、教育培训机构，甚至公安机关，如果对员工疏于管理，都可能成为信息泄露的源头。
四川省大邑县法院作出的一份判决书显示，2014年1月初，中国银行武侯支行曾某、李某来到位于大邑县的四川文轩职业学院，找到该学院成人高考办副主任代某，说想向学生推销银行卡。
之后，代某未经过学校许可和学生本人同意，通过聊天工具邮箱将3万余名学生的个人信息发给了曾某、李某。曾某、李某收到学生信息后，向银行申请批量制卡。
随后，曾某、李某将违规制作的35000余张中国银行企业园区金卡送到四川文轩职业学院交给代某，并向代某支付了人民币50000元，要求代某提供学生办卡申请表、身份证复印件等。代某拿了钱并将其存进自己的银行账户，用于辅导员召集学生填申请表的加班费，以及复印学生办卡申请表、身份证的费用。
